សហរដ្ឋអាមេរិកចាត់ទុកចំណាត់ការលើលោក កឹម សុខា និងការរំលាយគណបក្សសង្គ្រោះជាតិដោយគ្មានភស្តុតាងច្បាស់លាស់នោះថា ជាការបំផ្លាញប្រជាធិបតេយ្យនៅកម្ពុជា។
អ្នកនាំពាក្យក្រសួងការបរទេសអាមេរិក អ្នកស្រី ម៉ូហ្គែន អរថាហ្គឺស (Morgan Ortagus) ថ្លែងក្នុងវីដេអូខ្លីមួយ ដែលត្រូវបានបង្ហោះលើទំព័រហ្វេសប៊ុករបស់ស្ថានទូតអាមេរិកប្រចាំកម្ពុជានៅថ្ងៃទី១០ កញ្ញាថា បទចោទប្រកាន់ដែលត្រូវបានប្រើដើម្បីចាប់ខ្លួនលោក កឹម សុខា នោះ គឺជាបទចោទប្រកាន់ដែលគ្មានមូលដ្ឋាន។ អ្នកស្រីបន្តថា របបលោក ហ៊ុន សែន មិនបានបង្ហាញភស្តុតាងរឹងមាំ ដើម្បីរំលាយគណបក្សសង្គ្រោះជាតិនោះទេ ដែលទង្វើទាំងនេះជាការអនុវត្តបំពានរដ្ឋធម្មនុញ្ញរបស់កម្ពុជា៖ «រដ្ឋាភិបាលកម្ពុជាមិនទាន់បានកាត់ទោស ឬបង្ហាញភស្តុតាងណាមួយដ៏គួរឱ្យទុកចិត្តនោះឡើយ ដើម្បីបញ្ជាក់ចំពោះការអះអាងរបស់ខ្លួន ដែលត្រូវបានប្រើដើម្បីរំលាយគណបក្សប្រឆាំងដ៏ធំជាងគេ គឺគណបក្សសង្គ្រោះជាតិ និងដើម្បីដកតំណែងតំណាងជាប់ឆ្នោតត្រឹមត្រូវជាង ៥.០០០នាក់។ ទង្វើនេះបំផ្លាញលទ្ធិប្រជាធិបតេយ្យពហុបក្សនៅប្រទេសកម្ពុជា ដែលជាគោលការណ៍មានចែងក្នុងរដ្ឋធម្មនុញ្ញរបស់ប្រទេសនេះ។ សហរដ្ឋអាមេរិកសូមអំពាវនាវម្តងទៀតដល់រដ្ឋាភិបាលកម្ពុជាឱ្យទម្លាក់រាល់ការចោទប្រកាន់ទាំងឡាយទៅលើលោក កឹម សុខា ប្រគល់ឡើងវិញនូវសិទ្ធិនយោបាយ និងសិទ្ធិពលរដ្ឋជូនគាត់ និងដោះលែងនូវអ្នកទាំងឡាយណាដែលត្រូវបានឃុំខ្លួនតាមអំពើចិត្ត»។
ទន្ទឹមនេះ សហរដ្ឋអាមេរិកក៏អំពាវនាវដល់របបក្រុងភ្នំពេញឱ្យប្រកាន់យកជំហានជាក់ស្តែង ដើម្បីជំរុញការផ្សះផ្សាឡើងវិញ ដោយអនុញ្ញាតឱ្យប្រព័ន្ធផ្សព្វផ្សាយ និងសង្គមស៊ីវិលដំណើរការដោយមិនភ័យខ្លាចការគំរាមកំហែង ឬការសងសឹក ដោយសារការអនុវត្តសិទ្ធរបស់ពួកគេក្នុងការបញ្ចេញមតិ និងការជួបប្រជុំ ដែលធានាដោយច្បាប់ផងដែរ។
ការអំពាវនាវជាថ្មីទៀតរបស់កំពូលមហាអំណាចពិភពលោកនេះ ធ្វើឡើងបន្ទាប់ពីរបបលោក ហ៊ុន សែន បន្តឃុំខ្លួន លោក កឹម សុខា ក្នុងផ្ទះ ហើយស្ថានការណ៍ធ្លាក់ចុះផ្នែកសិទ្ធិមនុស្ស និងប្រជាធិបតេយ្យនៅកម្ពុជា នៅតែស្ថិតក្នុងភាពយ៉ាប់យ៉ឺនដដែល។
អនុប្រធានគណៈកម្មាធិការសិទ្ធិមនុស្សកម្ពុជា និងជាអ្នកនាំពាក្យក្រសួងយុត្តិធម៌ លោក ជិន ម៉ាលីន ចាត់ទុកសេចក្តីអំពាវនាវរបស់សហរដ្ឋអាមេរិកនេះ ថាជាការជំរុញឱ្យរដ្ឋាភិបាលបំពានច្បាប់។ លោកថ្លែងថា ទាំងករណីលោក កឹម សុខា និងការរំលាយគណបក្សសង្គ្រោះជាតិ សុទ្ធសឹងជាការអនុវត្តច្បាប់របស់ស្ថាប័នតុលាការ ដែលរដ្ឋាភិបាលមិនអាចលូកលាន់បានឡើយ៖ «វាដូចអត់មានរឿងអីចម្លែកទេ ដែលខាងស្ថានទូតលើកឡើង ហើយវាមិនមែនជាលើកទីមួយទេ ដែលធ្វើមិនព្រមយល់ មិនព្រមទទួលយកយន្តការអនុវត្តច្បាប់របស់កម្ពុជា។ ប្រហែលជាមានអីនៅក្រោយហ្នឹង ក៏ប៉ុន្តែខ្ញុំមិនអាចធ្វើការសន្និដ្ឋានបានទេ ទាល់តែសួរខាងស្ថានទូតអាមេរិក។ ក៏ប៉ុន្តែសម្រាប់កម្ពុជា យើងនៅតែប្រកាន់ជំហរថា អ្វីដែលខាងសហរដ្ឋអាមេរិកបានលើកឡើង គឺជាយន្តការនៃការអនុវត្តច្បាប់របស់កម្ពុជា»។
ប្រធានគណបក្សសង្គ្រោះជាតិលោក កឹម សុខា ត្រូវបានសមត្ថកិច្ចរបបក្រុងភ្នំពេញសម្រុកចូលចាប់ខ្លួនទាំងកណ្តាលអាធ្រាត្រថ្ងៃទី២ ឈានចូលថ្ងៃទី៣ កញ្ញា ឆ្នាំ២០១៧ ទាំងពេលដែលរូបលោកកំពុងមានអភ័យឯកសិទ្ធិសភា ក្នុងនាមជាអ្នកតំណាងរាស្ត្រស្របច្បាប់នៅឡើយ។ តុលាការរបបលោក ហ៊ុន សែន បានចោទប្រកាន់លោកពីបទ “សន្ទិដ្ឋិភាព” ឬការត្រូវរ៉ូវគ្នាជាមួយបរទេស ដើម្បីផ្តួលរំលំរដ្ឋាភិបាល។ របបក្រុងភ្នំពេញ តាមរយៈការស្រែកបន្ទរពីប្រព័ន្ធឃោសនាស្មោះស្ម័គ្រនឹងខ្លួន បានចោទសហរដ្ឋអាមេរិកថា ជាអ្នករៀបចំផែនការពីក្រោយខ្នងលោក កឹម សុខា។
បន្ទាប់ពីចាប់ខ្លួនលោក កឹម សុខា របបក្រុងភ្នំពេញបានរំលាយគណបក្សសង្រោះជាតិ នៅខែវិច្ឆិកា ឆ្នាំ២០១៧ ។ របបនេះបានហាមឃាត់ថ្នាក់ដឹកនាំគណបក្សនេះ មិនឱ្យធ្វើសកម្មភាពនយោបាយរយៈពេល៥ ឆ្នាំ ហើយបានយកអាសនៈសភា និងក្រុមប្រឹក្សាឃុំសង្កាត់ជាង ៥ពាន់អាសនៈរបស់បក្សប្រឆាំងទៅចែកគ្នាកាន់កាប់ ប្រៀបបាននឹងគេកាត់នំចែកគ្នាហូបយ៉ាងដូច្នេះដែរ។
បន្ទាប់ពីអវត្តមានបក្សសង្គ្រោះជាតិ របបលោក ហ៊ុន សែន បានរៀបចំការបោះឆ្នោតបែបបង្រ្គប់កិច្ច នៅចុងខែកក្កដា ឆ្នាំ២០១៨ ដោយក្រសោបយកអាសនៈសភាទាំងស្រុងមកក្តោបក្តាប់តែម្នាក់ឯង ធ្វើឱ្យកម្ពុជាប្រែក្លាយជាប្រទេសឯកបក្សមិនធ្លាប់មានក្នុងប្រវត្តិសាស្ត្រ ក្រោយកិច្ចព្រមព្រៀងសន្តិភាពក្រុងប៉ារីសឆ្នាំ១៩៩១។ ទង្វើទាំងអស់នេះហើយ ដែលសហគមន៍អន្តរជាតិនិយមប្រជាធិបតេយ្យវាយតម្លៃថា ជាការអនុវត្តផ្ទុយនឹងស្មារតីនៃរដ្ឋធម្មនុញ្ញ និងបទដ្ឋានអន្តរជាតិនានា ដែលកម្ពុជាបានចុះហត្ថលេខាទទួលស្គាល់។
អ្នកជំនាញខាងវិទ្យាសាស្ត្រនយោបាយ លោក ឯម សុវណ្ណរ៉ា យល់ថា មានមូលហេតុមួយចំនួនដែលសហរដ្ឋអាមេរិកអំពាវនាវម្តងហើយម្តងទៀតឱ្យមានការដោះលែងលោក កឹម សុខា។ លោកថា ទីមួយដោយសាររដ្ឋាភិបាលកម្ពុជាចោទអាមេរិកថា ជាអ្នកនៅពីក្រោយខ្នង លោក កឹម សុខា ដូច្នេះអាមេរិកចាំបាច់ត្រូវតែរកខុសត្រូវរឿងនេះ។ ទីពីរលោកថា ក្នុងនាមជាប្រទេសប្រជាធិបតេយ្យគំរូ សហរដ្ឋអាមេរិកចាំបាច់ត្រូវតែបង្ហាញកង្វល់របស់ខ្លួននៅពេលឃើញកម្ពុជាដើរផ្ទុយពីគោលការណ៍ប្រជាធិបតេយ្យ។ ម្យ៉ាងវិញទៀត លោកថាការអំពាវនាវនេះ ទំនងជាសហរដ្ឋអាមេរិកចង់ដាស់តឿនរដ្ឋាភិបាលកម្ពុជាឱ្យងាកមកដោះស្រាយបញ្ហានយោបាយស្រុកទេសវិញ ដើម្បីបញ្ចៀសទណ្ឌកម្មការទូត និងសេដ្ឋកិច្ចពីសហរដ្ឋអាមេរិកផ្ទាល់ និងពីសហភាពអឺរ៉ុប៖ «បើស្ថានភាពរបស់កម្ពុជាយើងអត់មានឆ្លើយតបទៅនឹងការលើកឡើងពីភាគីអាមេរិក ឬអឺរ៉ុបទេ ខ្ញុំគិតថា សហរដ្ឋអាមេរិកអាចនឹងមានវិធានការបន្តបន្ទាប់ ដូចជា ពន្លឿននីតិវិធីច្បាប់ពាក់ព័ន្ធនឹងច្បាប់ប្រជាធិបតេយ្យ H.R ៥២៦ ការជំរុញឱ្យមានការកោះប្រជុំសមាជិកហត្ថលេខីនៃកិច្ចព្រមព្រៀងសន្តិភាពក្រុងប៉ារីសឡើងវិញ ទីបី អាចវិធានការ GSP ដែលកម្ពុជាទទួលបានពីរឆ្នាំម្តងៗ ហ្នឹង»។
សមាជិកសភាសហរដ្ឋអាមេរិកកំពុងរៀបចំច្បាប់ស្តីពីប្រជាធិបតេយ្យកម្ពុជា ឆ្នាំ២០១៩ ឬ H.R.៥២៦ ដើម្បីដាក់ទណ្ឌកម្មរបបលោក ហ៊ុន សែន ចំពោះទង្វើរំលោភសិទ្ធិមនុស្ស និងប្រជាធិបតេយ្យធ្ងន់ធ្ងរនៅកម្ពុជា។ ច្បាប់នេះកំពុងស្ថិតក្នុងដៃព្រឹទ្ធសភាអាមេរិក ហើយប្រសិនបើច្បាប់នេះអាចអនុម័តបានមែន នោះសហរដ្ឋអាមេរិកនឹងបង្កកទ្រព្យសម្បត្តិ និងបដិសេធទិដ្ឋការមន្ត្រីគ្រាក់ៗ របបក្រុងភ្នំពេញមិនឱ្យជាន់ទឹកដីអាមេរិក។
ដោយឡែក សហភាពអឺរ៉ុបវិញកំពុងតែអនុវត្តនីតិវិធីព្យួរការអនុគ្រោះពន្ធ EBA ពីកម្ពុជា ហើយការសម្រេចចិត្តចុងក្រោយនឹងធ្វើឡើងនៅអំឡុងខែកុម្ភៈ ឆ្នាំ២០២០ ខាងមុខ។ សហភាពអឺរ៉ុបបានបញ្ជាក់រួចហើយថា ប្រសិនបើស្ថានភាពស្រុកខ្មែរមិនប្រសើរឡើងទេ នោះកម្ពុជានឹងបាត់បង់ការអនុគ្រោះពន្ធ ដែលធ្លាប់ទទួលបាននាពេលកន្លងមក។
អ្នកជំនាញខាងវិទ្យាសាស្ត្រនយោបាយ លោក ឯម សុវណ្ណារ៉ា ថ្លែងថា រដ្ឋាភិបាលគួរតែឆ្លើយតបជាវិជ្ជមានចំពោះកង្វល់ និងលក្ខខណ្ឌរបស់សហភាពអឺរ៉ុប និងសហរដ្ឋអាមេរិក បើពុំដូច្នេះទេកម្ពុជានឹងរងផលប៉ះពាល់ពីការដាក់ទណ្ឌកម្មរបស់ក្រុមប្រទេសប្រជាធិបតេយ្យទាំងនោះ៖ «អំណាចមិនស្ថិតលើតុលាការឯករាជ្យឯណា? តុលាការរបស់កម្ពុជាមានស្ថានភាពមួយក្រោមឥទ្ធិពលនៃគណបក្សកាន់អំណាចទេ។ នាយករដ្ឋមន្ត្រីលោកមានឥទ្ធិពលនៅក្នុងការដោះស្រាយទេ មិនមែនថា តុលាការផ្សេង នាយករដ្ឋមន្ត្រីផ្សេងនោះទេ អាហ្នឹងសហគមន៍អន្តរជាតិ ពលរដ្ឋកម្ពុជាក៏អាចមើលឃើញទិដ្ឋភាពនេះដែរ។ អ៊ីចឹងកន្លែងហ្នឹង ខ្ញុំគិតថា គួរឆ្លើយតបឱ្យត្រូវនឹងអ្វីដែលទិដ្ឋភាពជាក់ស្តែងជាជាងការដោះបន្ទុក។ កាលណាដោះបន្ទុក វាមិនអាចជាដំណោះស្រាយទេ»។
ទាក់ទងនឹងចំណាត់ការលើលោក កឹម សុខា និងការរំលាយគណបក្សសង្គ្រោះជាតិនេះ អង្គការឃ្លាំមើលសិទ្ធិមនុស្សអន្តរជាតិ យូមែន រ៉ៃត៍ វ៉ច្ឆ (Human Rights Watch) បានពិនិត្យឃើញថា ករណីនេះជារឿងនយោបាយសុទ្ធសាធ ហើយធ្វើឡើងដើម្បីរក្សាអំណាចរបស់លោក ហ៊ុន សែន។ អង្គការនេះវាយតម្លៃជារួមថា លោក ហ៊ុន សែន ដែលកាន់អំណាចជាង ៣០ឆ្នាំមកហើយនោះ បានប្រើល្បិចកលមិនស្របច្បាប់គ្រប់បែបយ៉ាង ដែលមានក្នុងសៀវភៅ ដើម្បីពង្រឹងការគ្រប់គ្រងបែបផ្តាច់ការឯកបក្ស និងកម្ទេចគណបក្សប្រឆាំងដែលមានសង្ឃឹមឈ្នះឆ្នោតតែមួយគត់នៅកម្ពុជា។ អង្គការអន្តរជាតិមួយនេះ ជំរុញឱ្យប្រទេសម្ចាស់ជំនួយ និងដៃគូពាណិជ្ជកម្មជាមួយកម្ពុជាទាំងអស់ ដាក់សម្ពាធឱ្យរបបក្រុងភ្នំពេញដោះលែងលោក កឹម សុខា ដោយឥតលក្ខខណ្ឌ ដែលជាជំហានឆ្ពោះទៅបញ្ឈប់ការធ្លាក់ចុះដុនដាបសឹងមិនគួរឱ្យជឿនៃវិស័យសិទ្ធិមនុស្សនៅកម្ពុជា៕
